What insurance is required for federal government contractors under FAR?

FAR Part 28 outlines the insurance requirements for federal contractors. At minimum, most contracts require general liability, workers’ compensation, and automobile liability coverage. Depending on the contract, you may also need professional liability (E&O) and cyber liability. Coverage limits are typically specified directly in your contract.

What is FAR 28 and why does it matter for my business?

FAR 28 is the section of the Federal Acquisition Regulation that governs bonds and insurance for government contracts. It requires contractors to maintain specific types and minimum amounts of insurance before work can begin. Non-compliance can result in contract termination or disqualification from future awards.

Do 8(a), WOSB, SDVOSB, HUBZone certified businesses have special insurance requirements?

Set-aside certified businesses follow the same FAR-mandated insurance requirements as other federal contractors. However, as these businesses often pursue growth through multiple contracts simultaneously, having scalable, FAR-compliant coverage in place early is critical to avoiding delays at contract award.

What is professional liability insurance and do government contractors need it?

Professional liability insurance, also known as E&O, protects contractors if a client claims your work or advice caused financial harm. Many federal agencies require it — particularly for IT, consulting, and engineering contracts. It is often listed as a requirement in the contract’s Section H or I.

Do government contractors need cyber liability insurance?

Yes — and increasingly it is being written directly into contract requirements. Contractors handling Controlled Unclassified Information (CUI) or subject to CMMC compliance should treat cyber liability as essential. A breach can trigger contract suspension, regulatory penalties, and significant remediation costs.

Can one insurance policy cover all my FAR compliance requirements?

Not typically. FAR compliance usually requires several coordinated policies — general liability, workers’ compensation, auto, professional liability, and sometimes cyber and umbrella coverage.
